3 year warranty

What is covered by the warranty?

The furniture elements, hinges, drawer slides, handles, shelf supporters or furniture elements, slatted bases, bought new by the client, person residing physically in the European Union, in Switzerland and in other countries through THÉO approved distributor.

The correctness of the self assembly instructions.

Madei Creations / THÉO™ reserves the following rights:

  • to appoint at its own expense, an internal or external expert to assert the damage and its causes so as to ensure the continuous improvement of our furniture.

  • To propose the replacement of parts when the replacement has a cost disproportionate to its repair.

  • To propose components or equivalent models in accordance with the availability of the furniture concerning its warranty.

Duration of the warranty

3 years starting from the date of delivery mentioned on the delivery form, or by default, from the invoice.

Prolonging of the warranty in case of immobilization of the good during its repair or its replacement during more than 7 calendar days.

Article L217-16 from the consumer code: “When the buyer asks the seller, during the time of the commercial warranty that was granted to them during the acquisition or repair of movable property, restoration covered by warranty, of a period of immobilization of at least seven days to be added to the duration of the warranty that remains.

This period runs from the request for intervention by the buyer or the provision for the repair in question, if this provision is subsequent to the request for intervention.”

Contents of the warranty

Madei Creations / THÉO™ warranty:

That  THÉO™ furniture or accessories are in fit for their intended usage as furniture or accessories, within normal usage conditions and being properly assembled following the instructions given by the manufacturer.

That the furniture or accessories corresponds to their description shown throughout diverse medias printed or online controlled by Madei Creations or reproduced by their distributors.

That THÉO™ furniture or accessories do not include any manufacturing defects or hidden defects, having gone through quality assessments at the factory.

What is excluded from the warranty?

Excluded from the warranty:

Imperfect assembly, not following the assembly instructions.

Imperfect use or maintenance, use of cleaning products that are not recommended.

Natural catastrophes or accidents, drops, impacts, discoloration due to light, burns, excessive heating, humidity, presence of insects, irregularities of the floor, natural variations of components.

Modifications, reparations or added elements that are not part of the furniture’s original components or pieces from the client or person not approved by the manufacturer.

Use for professional or commercial purposes.

Corrosion and oxidation.

Damage due to transport.

Regular use of furniture will result in aesthetic deteriorations and regular wear and tear that the warranty does not cover.


Limitations of the warranty:

THÉO™ warranty only allows for the replacement or repair of THÉO™ furniture or accessories. The contents of the furniture are excluded, notably all the goods that are stored inside the furniture, the assembly and cleaning costs and any damages linked to the unavailability of the furniture or accessories.

Reminder of the legal provisions of the warranty of conformity - extract from the Code of consumption:

Article L217-4: the seller is required to deliver goods in accordance with the contract and responds to any defects existing during its delivery. They also respond to defects resulting from packaging, assembly instructions or installations when it has been charged to do so by contract or has been carried out under their responsibility.

Article L217-5: to comply with the contract, the good must: 1˚ Be fit for use usually expected from a similar food amd, where applicable: -correspond to the description given by the seller and possess the qualities presented to the buyer as a sample or template; -present the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer or their representative, in particular in advertising or labelling; 2˚ Or present the characteristics defined by mutual agreement by the parties or be fit to any special purpose sought by the buyer, brought to knowledge of the seller that the latter has accepted.

Article L217-12: the action resulting from an effect is prescribed by two years to count from the day the good has been delivered.

Warranty against defects in the item sold - extract from the Civil Code:

Article 1641: the seller is bound by the warranty for hidden defects in the product sold that renders it unfit for its intended use, or that decrease its usage so much, that the buyer would not have acquired it, or would have bought it at a lower price, it the defect had been known.

Article 1648: 1st paragraph: the action resulting from defects must be brought to light by the purchaser within two years from the discovery of the defect.
